CHARLESTON - A woman is suing Shorest 1102 LLC for injuries she allegedly sustained while in its restaurant.
On Dec. 1, 2012, Janet Scott was a business invitee lawfully on the property and premises owned, controlled, managed, possessed and operated by Shorest, according to a complaint filed Sept. 11 in Kanawha Circuit Court. Shorest operates a Shoney's in Charleston.
Scott claims the defendant had a duty to manage, operate, monitor, inspect, repair, remedy and/or maintain all areas of its property and surrounding premises in a reasonably safe condition and to warn business invitees of dangerous and hazardous conditions it had knowledge of.
While Scott was walking on the premises, she slipped and fell as a result of a slippery substance next to the buffet area, according to the suit.
Scott claims she sustained injuries and suffered damages and losses from the fall.
As a result of the careless, reckless and negligent acts and violations of law by Shorest, Scott has been prevented from carrying out the duties and responsibilities of her life, has been prevented from leading her life socially and recreationally and has suffered an inability to perform normal activities, according to the suit.
Scott is seeking compensatory damages. She is being represented by Erika Klie Kolenich of Klie Law Offices PLLC.
The case has been assigned to Circuit Judge Carrie Webster.
