Woman sues Tidewater Restaurant over alleged fall

CHARLESTON - A woman is suing Real Seafood Company of Charleston Inc. for injuries she allegedly sustained while at its restaurant.

On Sept. 19, 2011, Janet Tolliver was being seated at the defendant's Tidewater Restaurant in Charleston when she slipped and fell, according to a complaint filed Sept. 11 in Kanawha Circuit Court.

Tolliver claims she suffered physical injuries from the unusually slip or slippery surface on its floors.

As a direct and proximate result of the defendant's negligent failure to maintain a safe premises, Tolliver suffered serious medical injuries, including injuries to both knees, according to the suit.

Tolliver claims she suffered medical expenses; pain and suffering; annoyance and inconvenience; and permanent injuries.

The defendant's negligence caused Tolliver to also suffer indignity, embarrassment, aggravation and mental anguish.

Tolliver is seeking compensatory damages. She is being represented by Richelle K. Garlow of the Law Office of Michael T. Clifford.

The case has been assigned to Circuit Judge Jennifer Bailey.
