LOGAN - A Logan County resident is suing her former employer over claims she was discharged without due process.
Rhonda Adkins filed the lawsuit on Aug. 29 in the Circuit Court of Logan County against Logan-Mingo Area Mental Health Inc., citing a property and liberty interest in continued employment.
Adkins says the defendant fired her on Aug. 31, 2011, after she allegedly abused an incapacitated adult.
The complaint states the plaintiff has a property and liberty interest in continued employment and must be granted due process, including notice and a hearing.
The West Virginia Department of Health and Human Resources Board of Review heard the case and found insufficient evidence that plaintiff abused the incapacitated adult, but the defendant failed to reinstate the plaintiff, according to the complaint.
Adkins is seeking an undetermined amount of damages.
She is being represented in the case by Madison attorney Timothy Conaway of Conaway & Conaway PLLC.
