Miner says faulty respirator caused black lung

LOGAN - A coal miner is suing companies involved with manufacturing and distributing a respirator that he claims failed to protect him from harmful dust, leading to lung cancer.

Willard Conley filed a lawsuit Aug. 16 in the Circuit Court of Logan County against Mine Safety Appliances Co., Persinger Supply Co., Raleigh Mine and Industrial Supply Inc. and Eastern States Mine Supply Co., citing gross negligence.

Conley claims the defendants failed to provide any type of warning the respirator they manufactured, sold and/or distributed had a defective filter that allowed him to inhale substantial amounts of harmful dust.

He now has “black lung” as a result of the faulty respirator, according to the brief.

The plaintiff is suing for an undetermined amount of relief, including compensatory and punitive damages. Conley is being represented by Mullens attorney G. Todd Houck.
