Mercer Co. man sues over installation of septic tank

PRINCETON - A Mercer County man is suing over claims his septic tank was improperly installed.

Kevin Hamm filed a lawsuit Oct. 2 in the Circuit Court of Mercer County against Clemons Construction LLC, citing negligence and breach of contract.

According to the complaint, Hamm entered into a contract with the defendant in April 2012 for the installation of a septic system. After the installation was complete, the plaintiff discovered the tank was not level and incorrect piping was used, according to the complaint.

Hamm is seeking an unspecified amount of damages, plus attorneys fees. He is being represented by Beckley attorneys Anthony M. Salvatore and Amy A. Osgood.

On Oct. 9, Senior Status Judge David W. Knight entered an order that said he had a conflict in presiding over the case.

The case was transferred to Judge William J. Sadler.
