PRINCETON - Two Virginia residents are suing over claims they purchased a nonconforming vehicle.
Kent Barrett and Nicole Barrett filed a lawsuit Oct. 4 in the Circuit Court of Mercer County against General Motors LLC, citing the Virginia Motor Vehicle Warranty Enforcement Act.
The plaintiffs say on April 13, 2012, they purchased a new 2012 Cadillac CTS from Ramey Automotive in Richlands, Va., with a four-year-or-50,000-mile warranty.
The complaint states the plaintiffs had to return the vehicle at least three times within the first 18 months because the roof leaked. The vehicle was out of service because of the repairs for more than 30 days, according to the complaint.
The plaintiffs contend the defendant was notified of the nonconforming Cadillac and failed to make repairs to the vehicle. The plaintiffs are claiming the Virginia Motor Vehicle Warranty Enforcement Act applies.
The plaintiffs are seeking a refund of the value of their trade-in, down payment, purchase price and legal fees. They are being represented by Princeton attorney William O. Huffman.
