Lawsuit alleging neglect filed against Logan Center

LOGAN - Logan Center is facing a lawsuit over claims it provided inadequate medical care to a resident, resulting in serious injury.

Norma Miller, as power of attorney for Janeth Stephens, filed suit in the Circuit Court of Logan County against Three Mile Curve Operations LLC, doing business as Logan Center and Genesis Healthcare Corp., citing statutory violations and negligence.

According to the plaintiff, Stephens was a resident of the defendant's nursing facility from March 31, 2012, through the present. While a resident at the facility, Stephens has been continuously subjected to poor care, neglect and abuse resulting in an acute fracture dislocation of the left ankle and comminuted fracture of the distal fibula shaft, according to the complaint.

The plaintiff claims the defendant's actions violated the West Virginia Code, which requires adequate nursing care, and constitutes negligence.

The plaintiff is seeking an undisclosed amount in damages. She is being represented by Charleston attorneys Andrew L. Paternostro and Jeff D. Stewart of The Bell law Firm PLLC.
