Discrimination suit against Capital Area Services settled

CHARLESTON - A lawsuit against Capital Area Services Company alleging discrimination was settled earlier this year after mediation.

Scott Bowlin and Kelley Mitchell, employees of Capital, were also named as defendants in the suit.

An agreed dismissal order was filed on Jan. 15 in Kanawha Circuit Court.

On Oct. 10, 2012, a notice of mediation was filed in Kanawha Circuit Court and on Oct. 23, 2012, mediation was held at the law offices of Dinsmore & Shohl LLP in Charleston, according to the notice of mediation.

On Sept. 19, 2009, Sara Beth McClanahan was fired from her employment with the defendants, according to a complaint filed Aug. 4, 2011, in Kanawha Circuit Court.

McClanahan claimed during her employment, she was repeatedly passed over for jobs that were given to men.

The defendants’ actions constituted sexual harassment and/or created a hostile work environment for McClanahan, according to the suit.

McClanahan claimed Bowlin also repeatedly made inappropriate comments about her and other female employees.

McClanahan was seeking compensatory and punitive damages with pre-judgment interest. She was being represented by Mark A. Atkinson of Atkinson & Polak PLLC.

The defendants were represented by Ashley C. Pack of Dinsmore & Shohl LLP.

The case was assigned to Circuit Judge Carrie Webster.
