Doctor wants disability coverage

WHEELING - A doctor is suing his employer after it allegedly breached their employment contract by allegedly failing to provide long-term disability coverage.

John J. Templeton, Jr., M.D. filed a lawsuit Oct. 9 in the Circuit Court of Ohio County against Greenbrier Emergency Services Inc. and Team Health Holdings Inc., citing breach of express contract, breach of implied contract, waiver and estoppel, reasonable expectations and fraud.

Templeton says he and Greenbrier Emergency Services entered into an employment agreement effective Dec. 1, 2011, for Templeton to provide full-time medical services as an employee of GES in the Emergency Department at Weirton Medical Center for an annual salary of $277,950 and long-term disability coverage up to $166,770.

According to the complaint, GES failed to secure the long-term disability coverage as it was required to do and on April 15, 2012, Templeton became disabled and was not able to receive any long-term disability benefits.

Templeton is seeking an unspecified amount of damages, both compensatory and punitive, plus costs and attorney fees. He is being represented in the case by attorneys Lester C. Hess, Jr. of Bachmann, Hess, Bachmann & Garden PLLC and Anthony I. Werner of John & Werner Law Offices PLLC.
