CHARLESTON – Dinsmore & Shohl’s Max L. Corley, III and Jason Nutzman will present two topics at the Southeast Mine Safety and Health Conference in Birmingham, Ala., on Nov. 5-7.
Both presentations are designed to prepare mine operators, contractors and safety personnel for Mine Safety and Health Administration (MSHA) actions.
Corley and Nutzman’s first topic, “MSHA Elevated Enforcement Strategies for Mine Operators/Contractors,” details the different levels of elevated enforcement and provides ideas for protecting evidence to defend against these types of actions. The presentation will also discuss ways to plan for elevated enforcement. Meanwhile, the second topic, “Handling MSHA Special Investigations: Mine Operators/Contractors,” lays the framework for avoiding, handling and defending against MSHA investigations involving foreman.
It will also discuss strategies for the company when faced with miners’ discrimination complaints. Corley and Nutzman will provide updates on recent commission and Administrative Law Judge decisions as well.
Corley is a Charleston Partner in the Employment, Labor and Benefits Department. His practice is focused on the defense of clients in federal and state coal mine safety and metal/nonmetal safety regulatory matters before federal and state administrative agencies, federal court and state courts and civil defense litigation.
Corley regularly represents mine operators and contractors in the coal industry and in the metal/nonmetal sector of MSHA enforcement. He actively defends operators and contractors in MSHA civil penalty proceedings, Section 110 special investigations of mine management and foremen, Section 105(c) miners' discrimination complaints, pattern of violations (POV), and other enforcement matters.
Nutzman is a member of the Employment, Labor and Benefits Department in the Charleston office. Nutzman represents both coal and metal/non-metal clients before the Federal Mine Safety and Health Review Commission in accident investigations, special investigations, and discrimination investigations conducted by the Department of Labor with respect to the Mine Safety and Health Act.
