Mingo couple allege Ford Explorer is defective

WILLIAMSON - A husband and wife from Mingo County are suing over claims that their 2013 Ford Explorer was dangerously defective.

Justin Kirk and Lisa Kirk filed a lawsuit Feb. 15 in the Circuit Court of Mingo County against Ford Motor Co., citing breach of warranty.

The plaintiffs claim the Ford vehicle they purchased on Sept. 25, 2012, has a defective condition and has jumped out of the park gear. They claim the vehicle's defective condition has continued despite attempts by the dealer to fix it.

The plaintiffs are suing for an amount of relief including the purchase price of the vehicle, repair costs and other damages. They are being represented by Williamson attorney Greg K. Smith.

On May 13, former Mingo Circuit Judge Michael Thornsbury entered a time frame order that scheduled a trial for Feb. 11. Thornsbury has since pleaded guilty to attempting to violate the civil rights of a man.
