BECKLEY - A car manufacturer is being sued after the occupant protection system allegedly failed to operate during a vehicle crash, leaving a man severely injured.
Erik L. Sweatte, by and though his mother and legal guardian Andrea Sweatte, and Andrea Sweatte, individually, filed a lawsuit Oct. 18 in Raleigh County Circuit Court against Ramey Automotive Group Inc., doing business as Ramey Mitsubishi, Mitsubishi Motors North America Inc. and Mitsubishi Motors Corp., citing negligence, gross negligence, products liability, strict liability, breach of warranty and loss of filial consortium.
According to the complaint, on Oct. 24, 2011, Erik Sweatte was operating a 2003 Mitsubishi Endeavor, owned by Vickie Stover, on County Route 8 near Stansford.
As Sweatte was traveling westbound, a 2003 Dodge Ram 2500 truck crashed into Sweatte's vehicle, the complaint says. Sweatte alleges that at the time of the crash, the 2003 Mitsubishi Endeavor's occupant protection system failed, causing serious injury and permanent harm.
The plaintiffs are seeking damages in excess of the jurisdictional limits. They are being represented in the case by attorneys Stephen P. New and S. Douglas Adkins.
