Woman says she was hit by tractor-trailer on I-68

CLARKSBURG - A family is suing a truck driver after a wife was allegedly hit by a tractor-trailer while walking on the side of an interstate to seek assistance.

Jillian McCune and Jason McCune, husband and wife, and Jillian McCune, as guardian and next friend of L.M., an infant under the age of 18 years old, filed a lawsuit Oct. 21 in U.S. District Court for the Northern District of West Virginia against All Pro Freight Systems Inc. and Patrick J. Coreno, citing negligence and loss of consortium.

The plaintiffs say that on Oct. 21, 2011, Jillian McCune was a pedestrian attempting to walk outside the left lane of eastbound Interstate 68 near Bruceton Mills and attempting to flag down a motorist to obtain cell phone assistance.

The complaint alleges that at the same time, Patrick J. Coreno was driving a 2007 tractor-trailer, owned by All Pro Freight Systems, traveling eastbound on Interstate 68 when he swerved from the right lane to the far side of the left lane toward McCune, striking her with the truck's front bumper and mirror, causing her serious bodily injury.

The McCunes are seeking an undisclosed amount of damages. They are being represented in the case by attorney Troy N. Giatras of The Giatras Law Firm PLLC.
