WHEELING - A couple are suing after a mining company allegedly damaged their property.
Keith McCord and Nancy McCord filed a lawsuit Oct. 28 in Ohio County Circuit Court against Consolidation Coal Company, doing business as Shoemaker Coal Mine.
According to the complaint, in January 2012 the defendant conducted long-wall mining under and adjacent to the plaintiff's property in Wheeling.
The complaint alleges the defendant damaged the buildings on the property, caused a loss of natural water supplies, a diminution of the total value of the property, loss of use of the property and annoyance and inconvenience.
The complaint also alleges the defendants violated the terms of the mining permit granted by the state and the Surface Coal Mining and Reclamation Control Act.
The McCords are seeking an undisclosed amount of compensatory and punitive damages. They are being represented in the case by attorney Eric M. Gordon of Berry, Kessler, Crutchfiled, Taylor & Gordon.
