CHARLESTON - Appalachian Tire Products Inc. is suing Hi-Tech Construction Company Inc. after it claims it failed to pay for goods and services.
Kimberly S. Jones was also named as a defendant in the suit.
Appalachian Tire Products sold and delivered goods and/or provided services to it from approximately March 2012 until June 2012 in a series of transactions, according to a complaint filed Oct. 22 in Kanawha Circuit Court.
ATP claims Jones personally guaranteed any debt owned by Hi-Tech to ATP, however the defendants have failed to pay for the goods sold and delivered and/or services provided.
The defendants owe ATP $57,587.96 plus interest in the amount of $9,787.17 from January 2012 for a total about of $67,375.13, according to the suit.
ATP is seeking compensatory damages in the amount of $67,375.13 with accumulating pre-judgment interest and post-judgment interest. It is being represented by Ryan S. Marsteller of Bailes, Craig & Yon PLLC.
The case has been assigned to Circuit Judge Tod J. Kaufman.
