Proposed settlement over car wreck would pay $70K

BECKLEY - A father is seeking a settlement agreement after his son was injured in a car crash.

Gaylon Burks, father and legal guardian of Zaylon Edward Burks, filed a petition for settlement Oct. 25 in the Circuit Court of Raleigh County against Katherine Y. Cochran.

According to the petition, Zaylon Burks, a two-year old, was hurt in an automobile accident on July 25, 2012.

The petition states that Burks was riding in a 2005 Suzuki operated by Tiffany Virginia Scott when the vehicle collided with a 2005 Chevrolet SUV operated by Cochran on Route 16, Robert C. Byrd Drive, in Beckley.

As a result of the crash, Burks sustained a contusion to the right area of his scalp and joint effusion with subsequent MRSA infection in the right knee.

The petition is seeking approval for a settlement in the amount of $50,000 be paid by Encompass Insurance Company and $20,000 be paid by GEICO.

Burks is being represented in the case by attorney Melissa R. Lyons of Farmer, Cline & Campbell PLLC.
