CHARLESTON - A South Charleston man is suing Go-Mart Inc. after he claims he allegedly sustained injuries while on its premises.
On Oct. 24, 2011, Mark Holmes was at the defendant's place of business when he fell over a rug that was obstructing a clear entrance into the store, according to a complaint filed Oct. 24 in Kanawha Circuit Court.
Holmes claims the defendant failed to maintain the premises in a reasonably safe condition and failed to provide adequate maintenance of their premises for the reasonable protection of those lawfully upon the premises.
The defendant negligently, carelessly, intentionally, willfully, wantonly and recklessly failed to perform and breached its duties owed to the plaintiff, according to the suit.
Holmes claims as a result of the defendant's breach of duty, he suffered severe and permanent physical and mental injuries to his person, his enjoyment of life has been greatly impaired and he has incurred great mental anguish.
As a result of the defendant's negligence, Holmes incurred medical expenses and suffered pain of body and mind, according to the suit.
Holmes is seeking compensatory damages. He is being represented by Shannon M. Bland of Bland & Bland.
The case has been assigned to Circuit Judge Jennifer Bailey.
