RIPLEY - Best Logging is being sued after an employee was allegedly involved in a fatal workplace accident.
Kimberly Dawn Westfall, individually and as Administratrix of the Estate of Jimmie Allen Westfall, filed suit in the Circuit Court of Jackson County on Nov. 5 against Roger L. Best, doing business as Best Logging, citing intentional exposure to injury and negligence.
According to the plaintiff, on Feb. 21, Jimmie was employed by Best Logging and working at a job site in Rock Castle. The complaint states the defendant directed Jimmie to work alone and to use a chainsaw without the appropriate safety equipment and training.
The plaintiff contends that as Jimmie was working alone, a tree fell on him and caused fatal injuries. Best Logging deliberately and intentionally exposed Jimmie to unsafe working conditions and the defendant's negligence proximately caused Jimmie's fatal injuries, according to the complaint.
The plaintiff is seeking an undisclosed amount in damages. She is being represented by attorneys Brent K. Kesner of Kesner & Kesner PLLC and Kevin Harris and Eric Holmes of the Law Offices of Harris & Holmes PLLC.
