WHEELING - A woman is suing after a Family Dollar store allegedly failed to pay her in a timely fashion following termination.
Tammy Sue Massey, individually and on behalf of a class of similarly-situated persons, filed a lawsuit Nov. 5 in the Ohio County Circuit Court against Family Dollar Stores of West Virginia Inc.
According to the complaint, West Virginia law requires employers promptly pay terminated employees their final paycheck in full within a specific time period following termination.
Massey alleges that despite the law, Family Dollar withheld her final pay and waited until the next regular payday to pay her following its decision to terminate her after 15 years of employment.
Massey is bringing the lawsuit on her behalf and on behalf of a class of West Virginia employees to remedy Family Dollar's violations of state law.
Massey is seeking a certification of the proposed class, unpaid wages and benefits, treble or liquidated damages, fees and other damages. She is being represented in the case by attorneys James G. Bordas III, Jason E. Causey and Michelle Marinacci of Bordas and Bordas PLLC.
