Miner seeks more than $4M after alleged workplace accident

BECKLEY - James Gregory Davis filed suit in the Raleigh County Circuit Court on Nov. 1, naming ICG Coal Group LLC, Arch Coal Inc. and George Taylor as defendants.

Davis is suing for injuries he allegedly sustained while working for the defendant companies. According to Davis, he is a mine electrician for the defendant companies and was working at Beckley Pocahontas Mine when he was ran over by a rubber-tired man trip buggy.

Davis claims he was working near defendant Taylor when Taylor pulled the throttle cable with a pair of channel locks. When Taylor did this, he allegedly caused the buggy to energize and run over Gregory, pinning him to the rib of the mine and injuring his leg.

Following the incident, Davis claims he was taken to the hospital, where remained for a week and underwent fibula and tibia surgery, which involved multiple procedures. The incident has allegedly left Davis' left leg unusable for work purposes and will require more surgeries in the future.

Davis is seeking to hold the defendants liable for his injuries, claiming they failed to take adequate measures to ensure a safe working environment.

Davis is seeking $4,265,000 in damages. He is being represented by attorney Richard Neely.
