Dominion Transmission sued over pipeline

WHEELING - Bruce A. Parsons and Brenda J. Parsons filed suit in the Ohio County Circuit Court on Nov. 6, naming Dominion Transmission Inc., Blue Racer Natrium LLC, The Trasher Group Inc. and Stantec Consulting Services Inc. as defendants.

The lawsuit stems out of the alleged trespass by defendants on the Parsonses' land in the Liberty District.

The Parsonses claim they granted defendant Dominion an easement for a right-of-way for one pipeline to be installed on their property. The plaintiffs allege between on Nov. 8 2011, and Feb. 5, 2012, the defendants began construction of the pipeline by cutting, damaging and carrying away timber.

The plaintiffs go on to say the defendants impermissibly timbered portions of their land and dug trenches or otherwise damaged their property outside of the easement right-of-way.

The plaintiffs claim this constitutes conversion, unjust enrichment, negligence and trespass.

The plaintiffs are seeking an injunction to stop the defendants from trespassing on their land. They are being represented by attorney Robert J. Fitzsimmons.
