Construction company abandoned project, lawsuit claims

NEW CUMBERLAND - William E. and Prudence G. Dziatkowicz filed suit in the Hancock County Circuit Court on Nov. 5, naming Vince Bruno Construction LLC and Vincent Michael Bruno as defendants.

According to the Dziatkowiczes, in July 2011, they executed a contract with the defendants to have a house built in Weirton for $248,250.

The Dziatkowiczes claim they made all payments as required by the contract, but withheld $19,860 after the defendants abandoned the construction of the house.

The Dziatkowiczes say the defendants made numerous mistakes prior to abandoning the project, including improper installation of floor beams and the roof, as well as failure to protect completed portions of the project from the elements during construction.

The Dziatkowiczes also claim the defendants failed to pay a lumber company, which resulted in a lawsuit against the Dziatkowiczes and a lien on their house. The Dziatkowiczes are suing for breach of contract and negligence, alleging the defendants failed to complete the project in a workmanlike manner.

The Dziatkowiczes are seeking more than $355,000 in damages. They are represented by attorney Lawrence L. Manypenny.
