WHEELING - John and Becky McCord filed suit in the Ohio County Circuit Court on Nov. 8, naming Consolidation Coal Co. as the sole defendant.
The McCords are suing over damages to their property allegedly caused by Consolidation.
According to the McCords, Consolidation owns the Shoemaker mine, from which it conducts longwall mining operations in Marshall and Ohio counties.
The McCords live on Stone Church Road in Wheeling. The McCords claim they entered into a subsidence agreement with Consolidation in February 2012, and the agreement purportedly furnished a procedure for how the McCords would be compensated for damages expected to occur as a result of Consolidation's longwall mining operation near or under their property.
The McCords have filed suit accusing Consolidation of failing to uphold their end of the agreement by not letting them choose their own contractor. They are suing for breach of contract and accused Consolidation of acting in bad faith.
The McCords are seeking more than $355,000 in damages. They are represented by attorney Eric M. Gordon.
