Woman sues Walmart for injuries from alleged fall

CHARLESTON - A woman is suing Wal-Mart Stores East LP after she claims she was injured while on its premises.

An unknown and unnamed individual was also named as a defendant in the suit.

On Oct. 20, 2011, Scyletha Pearl Lovejoy was having a perm put in her hair at the shop located inside Walmart in Cross Lanes and after her hair was washed and wrapped in perm rods and a waving solution applied, she proceeded to use the restroom, according to a complaint filed Oct. 18 in Kanawha Circuit Court.

Lovejoy claims when she arrived at the restroom, John Doe left the restroom with cleaning supplies, and she asked if she may use the restroom. Doe agreed without advising her that he had just mopped the floor, she claims.

When Lovejoy held the door for Doe to exit as she stepped in, her foot slipped from under her on the wet floor and she fell and suffered serious injury, according to the suit.

Lovejoy claims the defendants knew or should have known of the condition of the wet, slipper restroom floor, which created an unreasonable risk of harm to invitees, including her.

As a direct and proximate result of the defendants' breach of duty, Lovejoy suffered physical injuries and permanent disabilities, according to the suit.

Lovejoy is seeking compensatory damages with pre-judgment interest. She is being represented by Kimberly E. Williams and Mark A. Hunt of Mark A. Hunt & Associates PLLC.

The case has been assigned to Circuit Judge Paul Zakaib Jr.
