Erie Insurance questions claim of theft of business' truck

PINEVILLE - Erie Insurance Property and Casualty Co. filed suit in the Wyoming County Circuit Court on Nov. 7, naming Godfrey's Discount LLC, David L. Godfrey Jr. and Pioneer Community Bank Inc. as the defendants.

According to Erie, Godfrey's Discount LLC purchased a policy of commercial auto insurance on a 2011 Dodge Ram. Erie claims the Dodge was also a security lien owed to Pioneer Community Bank.

David L. Godfrey allegedly reported the Dodge stolen on July 6. Erie goes on to say that on July 3, the Dodge was diagnosed with bad injectors, and Godfrey was told not to drive it without replacing them.

Godfrey allegedly drove the vehicle away without replacing the injectors, but stated he had bought new injectors from the store the very next day. However, Erie claims the store from which he claims to have bought the new injectors was not open on July 4.

Now Erie questions whether the Dodge was actually stolen, or if fraud had occurred. Erie believes the Dodge may have been discarded by Godfrey after it was broken, in fear Pioneer Community Bank would recall the loan secured by the Dodge.

Erie seeks a declaratory judgment regarding the existence of coverage for the car. Erie is being represented by attorney Michelle E. Piziak.
