Nursing home sued over woman's death

CHARLESTON - A woman is suing Raleigh Manor LP after she claims it is responsible for her mother's death.

Raleigh Manor is doing business as Raleigh Center and/or Raleigh Nursing & Rehabilitation Center.

Dr. William Powers and Genesis Healthcare were also named as defendants in the suit.

On Sept. 28, 2012, Powers, acting individually and by and through his employment with the defendants, deviated from the applicable standard of care of Lelia Careway, according to a complaint filed Nov. 1 in Kanawha Circuit Court.

Peggy Rumbach claims the defendants negligently treated and cared for her mother while she was a resident of Genesis Healthcare Corporation's facility.

As a direct and proximate result of the negligence of the defendants, Careway's estate, through Rumbach, suffered mental pain and suffering; severe emotional distress; loss of kindly services; and has incurred medical and funeral expenses, according to the suit.

Rumbach is seeking compensatory and punitive damages with pre- and post-judgment interest. She is being represented by Marvin W. Masters and Charles M. Love IV of the Masters Law Firm LC.

The case has been assigned to Circuit Judge Paul Zakaib Jr.
