RIPLEY - A couple are suing the husband's employer after he was allegedly hit by falling logs while working at a property in LeRoy.
Kenneth Miller and Debra Miller filed a lawsuit Nov. 13 in the Circuit Court of Jackson County against Mark D. Caldon, citing negligence and loss of consortium.
According to the complaint on Nov. 19, 2011, Kenneth Miller was working for Caldon and using a chainsaw to cut a large number of stacked logs into firewood on Caldon's property near LeRoy.
Miller claims he was instructed to cut the stacked logs by starting on one end of the stack while the defendant started on the other end. He says that during the course of the work, Caldon climbed atop the log pile and began cutting pieces of firewood from the end of logs at the top of the stack, causing a log to fall from the top of the pile and strike Miller in the head and crush his left hand.
The Millers are seeking damages in an amount sufficient to compensate them for the injuries suffered. They are being represented in the case by attorneys Brent K. Kesner of Kesner & Kesner PLLC and Kevin Harris and Eric Holmes of Harris & Holmes PLLC.
