Putnam couple says home wasn't built to code

WINFIELD – A Fraziers Bottom couple is suing Love-Lee Construction after they claim it violated West Virginia code.

JPMorgan Chase Bank, Stave Branch Land Development and Poca Valley Bank were also named as defendants in the suit.

On June 13, 2013, Jason Drake and Stefanie Drake purchased real property together with a house in Fraziers Bottom to live and raise their family in a secure and safe environment, according to a complaint filed in Putnam Circuit Court.

The Drakes claim the property was constructed by Love-Lee and sold to the plaintiffs for $208,000.

The design and construction of the home did not meet code and construction industry standards, according to the suit.

The Drakes claim the financing was done through JPMorgan Chase and the bank intentionally provided a mortgage loan to the Drakes exceeding the market value of the property, which violates West Virginia code.

The plaintiffs suffered loss of total value of their property; costs for repairs; annoyance and inconvenience; emotional distress; and cancelation of their mortgage obligations, according to the suit.

The Drakes are seeking compensatory damages with pre- and post-judgment interest. They are being represented by Guy R. Bucci and J. Ryan Stewart of Bucci, Bailey & Javins LC.

The case is assigned to Circuit Judge Joseph Reeder.
