Six suits filed against Williams Ohio Valley Midstream for noise, pollution

MOUNDSVILLE - Six lawsuits have been filed against Williams Ohio Valley Midstream LLC after the plaintiffs claim they have been affected by noise and pollution from the facility.

Brenda Rine; David Poling and Kimberly Poling; Joshua Nelson and Tracie Nelson; Judith McGary; Timothy Dulaney and Shirley Dulaney; and Rickey McGary and Lisa McGary's properties are located near an oil and gas compressor that is owned by Williams, according to six complaints filed in Marshall Circuit Court.

The plaintiffs claim Williams' operations have caused fumes, dust, noise and light to be present on their properties during all hours of the day and night.

Williams' operations have caused black soot to be present on their dwellings and real property, according to the suit.

The plaintiffs claim the continuous and constant smell of the fumes and odors have forced the plaintiffs to continuously keep their home's windows closed and frequently make it unbearable for them to be outside on their properties.

Williams' operations have caused air pollution, dust, dirt and debris to travel onto their properties, which frequently makes it unbearable for the plaintiffs to be outside on their properties, according to the suits.

The plaintiffs claim they incurred substantial costs and expenses.

The defendant's conduct was outrageous, according to the suit.

The plaintiffs are seeking compensatory and punitive damages with pre- and post-judgment interest. They are being represented by James G. Bordas Jr. and Jeremy M. McGraw of Bordas & Bordas PLLC.

Ten lawsuits were filed in Marshall Circuit Court in December also claiming they suffered because of the pollution and noise. The plaintiffs were also represented by Bordas & Bordas.

The cases are assigned to Circuit Judges David W. Hummel Jr. and Mark A. Karl.
