Woman accuses mortgage company of abusive practices

CHARLESTON – A woman is suing Green Tree Servicing for abusive loan-servicing practices that caused her damages.

Leah Ann Davis had a home-secured loan serviced by Green Tree and on numerous occasions, the defendant failed to fully credit her loan payments, according to a complaint filed in Kanawha Circuit Court and removed to federal court on June 24.

Davis claims on July 14, 2014, she made a regular payment of $530, but Green Tree only credited a payment of $418.79.

On Aug. 11, 2014, Davis made another $530 payment and was only credited a payment of $418.79, according to the suit.

Davis claims Green Tree placed numerous debt collection calls to her mother, Carmen Johnson, and despite Johnson informing Green Tree that Davis did not live there and requested they stop calling and harassing her.

Green Tree also placed debt collection calls to Johnson's place of work in order to harass Davis, according to the suit.

Davis claims it unlawfully applied force placed insurance in October even though she provided them with proof of homeowners' insurance through State Farm.

By unlawfully charging Davis for forced placed insurance, Green Tree violated West Virginia code, according to the suit.

Davis is seeking compensatory damages with pre- and post-judgment interest. She is being represented by Jonathan R. Marshall and Tony L. Clackler II of Bailey & Glasser LLP.

The case is assigned to District Judge Thomas E. Johnston.
