Woman sues Best Buy for injuries

HUNTINGTON - A Cabell County woman is suing Best Buy Stores LP after she claims she was injured in one of its stores.

On Aug. 10, 2013, Tara Scarberry was inside the Best Buy store in Barboursville when her right foot and leg penetrated a section of the floor, causing her to suffer injuries, according to a complaint filed in Cabell Circuit Court.

Scarberry claims her right leg went into and under the floor up to her knee area and she had no warning or reason to believe that the floor section would collapse, causing her injuries.

The store did not provide any notice to her that the floor was defective, dangerous or a hazard in any way, according to the suit.

Scarberry claims the floor section was a dangerous condition and was unreasonably unsafe.

Best Buy was negligent in maintaining the floor in a safe and careful manner, according to the suit.

Scarberry is seeking compensatory damages with pre- and post-judgment interest.

She is being represented by Jay C. Love. The case is assigned to Circuit Judge Christopher D. Chiles.
