CHARLESTON – A Kanawha County woman and her husband are suing Save-A-Lot of St. Albans after they claim she was injured on their property.
Hoffman Grocery Inc. is doing business as Save-A-Lot of St. Albans.
On Aug 24, Drema. L. Parog and John Parog were at Save-A-Lot shopping for groceries, according to a complaint filed in Kanawha Circuit Court.
The Parogs claim one or more of the cookers used to refrigerate food items was leaking water onto the floor of the store, which they were unaware of and were not warned about.
Without having been warned of the dangerous condition posed by the leaking cooker, the plaintiffs proceeded to the area of the leak where Drema Parog slipped and fell on the slippery floor, according to the suit.
The Parogs claim the defendant breached its duty to them by failing to exercise reasonable care in maintaining its premises and/or by failing to protect them from the defective and dangerous condition posed by the leaking cooler.
As a direct and proximate result of the defendant's acts and/or failures to act and negligence, the Parogs have suffered injuries, according to the suit.
The Parogs are seeking compensatory and punitive damages with pre- and post-judgment interest. They are being represented by Scott S. Segal of the Segal Law Firm.
The case is assigned to Circuit Judge Jennifer Bailey.
