RIPLEY—A Jackson County couple is suing a timber company, alleging incidents of property breach.
Shirley L. Meadows Jr. and Zelma Mae Meadows filed a lawsuit June in Jackson Circuit Court against Top Notch Logging, care of James M. Wyant of Ravenswood, alleging trespassing and theft.
According to the filing, since Aug. 11, 2014, the plaintiffs have owned a 53-acre tract of land in the Grant District of Jackson County, having purchased it from the previous owner, Anita J. Weller. The suit says Weller signed over all claims to the couple as of June 3, 2015.
The complaint states at various times in 2014, the defendant entered the plaintiffs’ property and “did unlawfully cut, damage or carry away or cause to be cut, damaged or carried away timber, trees, logs, posts, fruit, nuts growing plants or product of a growing plant” in violation of state code.
The plaintiffs allege substantial property damage.
The Meadows couple seeks treble damages for the value of the stolen materials, compensatory and punitive damages, attorney fees and costs. The are represented by attorney Leah Chappell of Adams, Fisher & Chappell in Ripley. The case has been assigned to Circuit Judge Thomas C. Evans III.
