Marshall County resident sues cement mixing company for negligence after vehicle collision

MOUNDSVILLE -- A Marshall County man is suing a concrete cement mixing company for negligence after both parties were involved in a vehicular collision.

Larry Chambers filed a suit July 2 in Marshall Circuit Court against Essroc Ready Mix Corp. and Robert Rouse, a driver for the company. Chambers filed on behalf of himself and his daughter, Laren, who was a passenger in the vehicle.

The plaintiffs claim that they were stopped at a red light in Moundsville on Feb. 19, 2104, when Rouse, while driving a cement mixer for Essroc, rear-ended the 1999 Pontiac Grand Am Chambers was driving. According to the claims, the law enforcement officer responding to the scene determined that Chambers was not at fault for the collision.

The plaintiffs cite damages including permanent physical injuries, loss of enjoyment of life and medical expenses, among others.

The plaintiffs seek damages "in excess of the minimum jurisdictional limits" to compensate for their sustained injuries, legal costs and attorney fees. They are being represented in the case by David Jividen and Chad Haught of Jividen Law Offices in Wheeling. Chambers' case is assigned to Judge Jeffrey Cramer.
