Logan woman alleges negligence, fraud by nursing home

A Logan County woman is suing a local nursing home, alleging negligence and fraud.

Gaye Morrison, on behalf of Cora Marie Vanover, filed a lawsuit June 30 in the Logan Circuit Court against the Logan branch of Trinity Health Care Services Inc. and one of the facility's administrators, Mark Noe. Twenty unidentified persons involved in Vanover's care also were named as separate defendants in the suit.

According to the complaint, Trinity Health Care of Logan and its faculty affirmed to Vanover's family they would be able to adequately care for the 86-year-old woman, who suffered from dementia, during her stay at the facility from June-September 2014, despite knowing about budgetary restrictions on staffing and supplies that would render such care impossible.

The suit alleges numerous injuries sustained by Vanover, including sexual abuse, infections, otherwise unnecessary hospitalization and related medical fees.

Morrison seeks compensatory and punitive damages for medical expenses, suffering, mental anguish and legal costs. She is represented by attorney Michael Fuller of the McHugh Fuller Law Group in Charleston and Hattiesburg, Miss. The case has been assigned to Circuit Judge David Pancake.
