RIPLEY -- A Jackson County woman is suing over claims that negligent engineering practices diverted water from a nearby construction project in a manner that damaged her property.
Connie Thomas filed a suit June 24 in Jackson Circuit Court against a number of defendants, including the Jackson County Board of Education, Double C. Enterprises, and the engineering firms American Geotech Inc. and ZMM Inc., citing negligence.
Thomas is also pressing charges against several unnamed insurance companies to provide coverage for her damage claims.
According to the suit, Thomas' property was damaged when a school construction project initiated by the Jackson County Board of Education improperly diverted water flow into her land. The land had suffered a slip and underwent remediation work prior to Thomas' purchase. Thomas claims that part of the damage was due the board of education failing to consider alterations to her property's subsurface structure following the slip repair.
The plaintiff is seeking punitive and compensatory damages, as well as those for attorney and legal fees. She also seeks compensation from the defendant insurance companies.
Thomas is represented by James Pierson of Pierson Legal Services PLLC, in Charleston. Judge Thomas C. Evans has been appointed to the case.
