Woman sues father of infant for reporting false rape allegations

CHARLESTON – A woman is suing the father of her infant child after she claims he created a hostile work environment by reporting false rape allegations.

Kathryn A. O'Neal and Dr. Ronbir M. Biswas have an infant daughter together and O'Neal began seeking child support for the infant, according to a complaint filed in Kanawha Circuit Court.

O'Neal claims Biswas' outrageous conduct began upon learning that she was seeking child support and a short time after she had requested help in supporting their child, Biswas falsely accused her of raping him, cutting his genital with a razor blade, forcibly ejaculating him and then using his semen to impregnate herself.

The defendant repeatedly humiliated O'Neal by continuing to falsely accuse her of rape, according to the suit.

O'Neal claims the defendant reported, on many occasions, his false accusations to her employer, co-workers and friends.

The defendant also reported his false accusations to the Charleston Police Department and repeatedly attempted to have O'Neal criminally prosecuted based on the false information, according to the suit.

O'Neal claims when Biswas' attempts to have her criminally prosecuted failed, he persisted with his outrageous pattern of harassment and lies by continuing to falsely report rape allegations at her place of work and also by filing a frivolous Public Safety Order against her.

A hearing was held on the defendant's petition and the magistrate denied the petition, according to the suit.

O'Neal claims the defendant still currently spreads false, humiliating and untrue information regarding untrue allegations against her.

The lawsuit lists claims of negligent infliction of emotional distress; slander; tort of outrage; and intentional infliction of emotional distress.

O'Neal is seeking compensatory and punitive damages with pre-judgment interest. She is being represented by Troy N. Giatras and Matthew Stonestreet of the Giatras Law Firm PLLC.

The case is assigned to Circuit Judge Louis Bloom.
