LOGAN—A Logan County man is suing his former employer, alleging unlawful employment practice and retaliatory discharge following the plaintiff’s successful worker’s compensation benefits claim.
Lewis E. White II filed a lawsuit against Performance Service Group of Charleston in Logan Circuit Court, alleging wrongful discharge in June.
According to the filing, White began working for the defendant Oct. 6, 2011, and when he was injured on the job Aug. 8, 2014, he filed a worker’s compensation claim that was ruled compensable.
White alleges his employer was out of compliance and acted with discrimination when it terminated him Feb. 4, 2015, allegedly in retaliation for his claim. The lawsuit states when White was released to return to work on June 4, 2015, the firm refused to reinstate him. The plaintiff alleges he has suffered embarrassment, emotional distress and mental anguish.
White seeks injunctive relief including rehiring with back pay or front pay in lieu of reinstatement, compensatory and punitive damages and other relief as the court deems appropriate, plus attorney fees and costs. The case has been assigned to Circuit Judge Roger L. Perry.
