CHARLESTON – Another lawsuit has been filed against Antero Resources Corporation for damages due to the company's fracking practices.
Antero Resources Appalachian Corp., Hall Drilling LLC and Noble Energy Inc. were also named as defendants in the suit.
Bethany D. Andexler owns property in Tyler County that is in close proximity to numerous well pads owned, operated, drilled, maintained or otherwise controlled by the defendants, according to a complaint filed in Kanawha Circuit Court
Andexler claims living in Tyler County, she had come to expect and enjoy the quiet, fresh air; fresh water; privacy; darkness of night; and overall peacefulness of the area.
The defendants' activities and instrumentalities frequently produce spills, emissions and discharges of hazardous gases and materials, chemicals and other industrial/hazardous wastes, according to the suit.
Andexler claims the defendants' negligent and/or unreasonable natural gas activities, acts and/or omissions have frequently, repeatedly and substantially interferred with her use and enjoyment of her property.
Due to the defendants’ activities, Andexler has been forced to breathe these emissions on a frequent basis, which substantially contributes to her harms and damages, according to the suit.
Andexler claims due to the defendants’ activities, she has suffered and continues to suffer damages to herself, her property, her quality of life and her rights to the use and enjoyment of her property.
The defendants have frequently, repeatedly and substantially interfered with Andexler's use and enjoyment of her property, according to the suit.
Andexler claims the defendants actions have caused her substantial discomfort, inconvenience, annoyance, offense to the senses, loss of peace of mind, angst, anxiety, distress, disgust, embarrassment, fear, apprehension, concern, difficulty sleeping, health concerns, deprivation of the ability to further develop the property, destruction of the serenity of the property and concern for water and air quality.
The defendants have also repeatedly concealed the dangerous nature of their natural gas activities and the impact these activities have on nearby landowners and the environment, according to the suit.
Andexler is seeking compensatory and punitive damages. She is being represented by Aaron Harrah and James D. Peterson of Hill Peterson Carper Bee & Deitzler PLLC; and Anthony J. Majestro of Powell & Majestro.
The case has been assigned to Circuit Judge Louis Bloom.
Multiple lawsuits have been filed against Antero for fracking since December in Kanawha Circuit Court.
