Man says he was injured outside Malden restaurant

CHARLESTON – A Kanawha County man says he was injured when he slipped on ice outside of a Malden restaurant.

Stephen B. Mayes filed his complaint against Better Foods Inc. in Kanawha Circuit Court. Better Foods is the parent company of Gino’s Pizza and Spaghetti House as well as Tudor’s Biscuit World. Gino’s and Tudor’s share a building in Malden.

On Feb. 25, Mayes said he fell on ice at the restaurant. He says the ice was not readily apparent to him, but he says it was present for enough time that the defendant company should have remedied the situation.

Mayes says he injured his neck, head and back and that he required medical treatment and will require treatment in the future. He seeks compensatory damages for his injuries as well as court costs, attorney fees, pre- and post-judgment interest and other relief.

He is being represented by Scott H. Kaminski of Balgo & Kaminski LC in Charleston. The case has been assigned to Circuit Judge Carrie Webster.
