CHARLESTON - A former employee is using Little Caesar's Pizza after he claims he was discriminated against based on his sexual orientation.
VDM Management Company LLC is doing business as Little Caesar's Pizza.
Little Caesar's Enterprises Inc.; D.L.C. Pizza Inc.; Genesis 4 LLC; and Mike Insco were also named as defendants in the suit.
Troy Young was employed at Little Caesar's and, during his employment, he was subjeted to unlawful discrimination based on his sexual orientation, according to a complaint filed June 18 in Kanawha Circuit Court.
Young claims Insco commonly referred to him as a "faggot" and made other unwelcome and insulting slurs based on his sexual orientation.
The defendants were aware of the discriminatory comments and failed to take timely and appropriate corrective action, according to the suit.
Young claims in June 2014, an unfounded complaint was made against him by a co-worker and he was suspended without pay for three days pending an investigation.
Insco instructed Danielle Thompson, a supervisor, to investigate the matter, and when she completed her investigation, she reported that the complaint was unfounded and Insco advised her to "make something up" and "fire the..faggot anyway," according to the suit.
Young claims on June 9, 2014, his employment was terminated.
The defendants violated the West Virginia Human Rights Act by wrongfully terminating Young's employment and by discriminating against him because of sexual orientation, according to the suit.
Young is seeking compensatory and punitive damages. He is being represented by Ben Salango of Preston & Salango PLLC; and Matthew C. Smith and Adam Campbell of Campbell & Smith PLLC.
The case is assigned to Circuit Judge James C. Stucky.
