Man sues Genesis Healthcare for wife's death

CHARLESTON - A man is suing Genesis Healthcare after he claims it is responsible for his wife's death.

Genesis WV Holdings LLC; 1631 Ritter Drive Operations LLC; John Does 1 through 10; and Unidentified Entities 1 through 10 (as to Raleigh Center) were also named as defendants in the suit.

Barbara Bailey was a resident of Raleigh Center from May 29, 2014, through July 7, 2014, according to a complaint filed May 27 in Kanawha Circuit Court.

Albert Bailey claims his wife died on July 19, 2014, having suffered injuries and damages during her residency at Raleigh Center.

The defendants failed to provide Barbara Bailey with oxygen, caused her to suffer from COPD and pneumonia, and eventually, her death, according to the suit.

Albert Bailey claims the nursing home defendants owed a duty to residents to act in a manner consistent with the proper operation of the nursing homes they controlled, which a reasonably careful person/corporation would provide under similar circumstances.

The defendants were negligent in causing Barbara Bailey's injuries and caused her extreme pain, suffering, mental anguish, embarrassment, fright and death, all of which required hospitalization and medical treatment, according to the suit.

Albert Bailey is seeking compensatory and punitive damages. He is being represented by James B. McHugh, Michael J. Fuller Jr., D. Bryant Chaffin and Kendra R. Fokakis of McHugh Fuller Law Group PLLC.
