BECKLEY – A Raleigh County woman is suing Logan's Roadhouse after she was injured on its premises.
On July 4, 2013, Deirdre Martin was employed at Logan's and was performing her work duties when she slipped on a piece of raw meat and fell, according to a complaint filed in Raleigh Circuit Court.
Martin claims she was unable to stand or put weight on her left leg and was taken by ambulance to Raleigh General Hospital emergency room and was diagnosed with left knee pain.
On July 8, 2013, Martin still had pain in her left knee and sought treatment at New River Health Associates and was seen by Dr. Prakash R. Puranik at ARH Orthopedics, according to the suit.
Martin claims it was not until Sept. 16, 2013, that Puranik advised she could return to regular work duty for eight hours per day.
Upon returning to work, Martin was demoted and no longer received the amount of tables and customers she previously had and no longer received the same amount of tip share as she did before the incident that left her injured, according to the suit.
Martin claims Logan's violated the West Virginia Human Rights Act by discriminating against her based on a perceived disabilty.
The working conditions created by Logan's were so intolerable that Martin was compelled to quit, according to the suit.
Martin is seeking compensatory and punitive damages. She is being represented by Tammy Bowles Rains of Tammy Bowles Rains Law Office PLLC; and Stephen P. New and Amanda J. Taylor.
