WAYNE – A Prichard woman is suing Alternative Building Concepts Inc. after she claims it breached its contract with her.
On March 24, 2014, M. Sandra Copley and the defendant entered into a written contract where the defendant agreed to provide home improvement services to Copley's residence in Prichard, according to a complaint filed in Wayne Circuit Court.
Copley claims the contract contemplates three separate phases of work by the defendant and the first phase was to relate to the structural stability of the residence, the second phase was to relate to the interior floor restoration and the third phase related to corrective measures necessary as to any exterior drainage problems.
The contract required a total contract price of $58,785.90 and Copley paid the contract price by a down payment of $10,000 on March 24, 2014, and a payment in the amount of $48,785.90 on April 29, 2014, according to the suit.
Copley claims she was subsequently induce by the defendant to execute two change orders on April 29, 2014, increasing the total contract price by $72,987.20 to $131,773.10 and Copley paid a total down payment of $10,000 toward the two change orders.
As of April 29, 2014, Copley has paid the defendant a total of $68,785.90, according to the suit.
Copley claims the defendant materially breached the contract by failing to provide the work and services as required by the contract.
The plaintiff was forced to hire another contractor to complete the improvements contemplate by the contract at an additional cost of approximately $74,100, according to the suit.
Copley claims Alternative refunded her $10,000, but still did not fulfill the contract.
Because of the breach of contract, Copley suffered damages, economic loss, expectation damages, reliance damages and other damages, according to the suit.
Copley is seeking compensatory damages with pre- and post-judgment interest. She is being represented by Tim C. Carrico of Carrico Law Offices LC.
