WAYNE – A Marshall County woman is suing Golden Girl after she lost her foot due to a boating accident.
Cecilia Ross also was named as a defendant in the suit.
On June 8, 2013, Brittany Hackney was a minor child at Golden Girl's group home for teenage girls and she, along with other girls and staff members went to Cave Run Lake in Morehead, Ky., according to a complaint filed in Wayne Circuit Court.
Hackney claims she was getting on an inflatable raft to take her turn tubing and had signaled that she was not ready to go as there was a thick rope wrapped around her right ankle and she was not fully inside the inflatable raft.
Despite the fact that she was not fully inside the inflatable raft and was entangled in the tow rope, Ross began to accelerate the boat, causing the rope to tighten around Hackney's right foot, according to the suit.
Hackney claims Ross caused the boat to accelerate at such a pace as to cause the rope entangled around her foot to tighten and pull her, with force, into the air by her foot.
Ross operated the boat carelessly, negligently and recklessly, causing the boat to accelerate rapidly and causing the rope to tighten with such force as to largely amputate Hackney's right foot at her ankle, according to the suit.
Hackney is seeking compensatory and punitive damages. She is being represented by Brent K. Kesner and Shawn C. Gillispie of Kesner & Kesner PLLC; and Kevin Harris of Harris & Holmes PLLC.
The case is assigned to Circuit Judge James Young.
