Pedestrian plunges into ruptured pavement, blames construction business

HINTON – A North Carolina resident is suing a Pennsylvania building firm doing business in West Virginia claiming premises negligence in a 2013 construction-related sidewalk accident.

Nancy Prince of Monroe, N.C., filed a lawsuit against Shaka Inc. of Jeannette, Pa., in Summers Circuit Court, asserting negligence and breach of duty in June 2013.

The suit states that the plaintiff was walking on a pedestrian walkway at Bellepoint Park near Bluepoint Dam in Summers County on June 22, 2013. According to the complaint, a portion of the surface had been excavated, leaving an unmarked hole. Prince allegedly tripped on the pavement, fell into the hole, and fractured her left elbow.

The suit states that Shaka, which had been performing construction work on the premises just prior to the incident, failed to place any warning or notification of the uneven surface.

Prince maintains pain, anguish, impairment, medical expenses, and loss of enjoyment of life due to fright and apprehension.

She seeks compensatory and punitive damages, attorneys’ fees, and costs.

The plaintiff is represented by Jonathan Mani of Mani Ellis & Lane in Charleston, W.Va. The case has been assigned to Judge Robert A. Irons.
