CHARLESTON – A woman is suing Genesis Healthcare for negligence and the wrongful death of her family member.
Genesis Healthcare LLC; Genesis Operations LLC; Glenmark Associates Inc; Saddle Shop Road Operations LLC; John Does 1 through 10; and Unidentified Entities 1 through 10, as to Hilltop Center, were all named as defendants in the suit.
On March 26, 2011, Gladys Cottle was admitted to Hilltop Center and remained a resident there until April 9, 2014, according to a complaint filed in Kanawha Circuit Court.
Margaret Cottle claims Gladys Cottle died on April 13, 2014, as a result of the injuries she suffered while at the defendants' facility.
Gladys Cottle suffered falls, fractures, pressure sores, dehydration, weight loss and, ultimately, her death, according to the suit.
Margaret Cottle claims Gladys Cottle lost her personal dignity and her death was preceded by extreme and unnecessary pain, degradation, anguish, otherwise unnecessary hospitalizations, disfigurement and emotional trauma.
The defendants were negligent and caused the plaintiff damages, according to the suit.
Margaret Cottle is seeking compensatory and punitive damages. She is being represented by James B. McHugh, Michael J. Fuller Jr. D. Bryant Chaggin and Kendra R. Fokakis of McHugh Fuller Law Group PLLC.
The case is assigned to Circuit Judge Jennifer Bailey.
