CHARLESTON – A Charleston woman is suing Environmental Management Inc. after she claims she was injured on its property.
THF Management Inc. also was named as a defendant in the suit.
On July 13, 2013, Vicki Lee Parsons was attempting to enter the Kohl's department store in South Charleston and approached the double doors to the right of the store, when she stepped onto the sidewalk and her feet violently went out from underneath her, according to a complaint filed in Kanawha Circuit Court.
Parsons claims she fell backward, hitting her head on the concrete.
The plaintiff immediately felt intense pain in her head and neck and several people came to assist her as she was lying on the ground, according to the suit.
Parsons claims an unidentified Kohl's employee came outside and gathered information for an incident report and emergency responders were called and arrived on the scene shortly thereafter.
The plaintiff was taken to Charleston Area Medical Center's emergency department, where she was examined and assessed to have suffered a non-displaced left occipital skull fracture and a grade I anterolisthesis of L5-S1, according to the suit.
Parsons claims due to the severity of the injuries she sustained when she fell, she continues to suffer from physical pain.
The defendants had a duty to provide a safe environment for invitees and was negligent in that duty, according to the suit.
Parsons is seeking compensatory damages. She is being represented by Damon L. Ellis of Mani Ellis & Layne PLLC.
The case is assigned to Circuit Judge Louis Bloom.
