BECKLEY—A Raleigh County woman is suing a Georgia-based corporation doing business in Charleston and its employee alleging tortuous injury, negligence, recklessness and vicarious liability in a four-vehicle roadway collision.
Mable Jean Gershen filed a lawsuit July 27 in Raleigh Circuit Court against Joseph Eric Perry and Thyssenkrupp Elevator Corporation of Alpharetta, alleging vehicular negligence in 2013.
According to the complaint, on Aug. 31, 2013, Gershen was a passenger in a 2010 Chevrolet Camaro driven by her husband traveling northbound on U.S. Route 19 near Glen Morgan in Raleigh County. The suit says the plaintiff’s vehicle was stopped behind a 2005 Nissan Titan operated by Roger Thomas who in turn was stopped behind a 2002 Subaru Legacy operated by Shirley Price, who was preparing to turn left onto Tank Branch Road from U.S. 19.
The suit says Perry approached Gershen’s vehicle from the rear in a 2006 Ford Econovan E350 owned by Thyssenkrupp, failed to control his vehicle and struck the Gershen vehicle with such force that all consecutive automobiles were impacted one by one.
The plaintiff alleges ongoing pain, suffering, annoyance, impairment, medical expenses, lost wages and diminished capacity to enjoy life.
Gershen seeks compensatory and punitive damages, pre- and post-judgment interest, attorney fees and costs. She is represented by attorneys Robert D. Cline Jr., Brian Bigelow and Melissa Lyons of Farmer, Cline & Campbell in Beckley. The case has been assigned to Circuit Judge John A. Hutchison.
