Nationwide sues Liberty Transportation over water damage from refrigerator

An insurance company has filed suit over an incorrectly installed refrigerator that caused considerable water damage to an insured party's home.

Nationwide Property & Casualty Insurance Company filed a lawsuit on Aug. 14 in Ohio County Circuit Court in West Virginia against Liberty Transportation, Inc. for the costs of water damage incurred after a refrigerator was installed incorrectly.

Thomas Fahey, the insured, was present when Liberty Transportation delivered the refrigerator on Dec. 6, 2014. On Dec. 9, Fahey said he discovered water running into his basement and traced it back to the refrigerator. Technicians were sent by Liberty Transportation to rectify the matter, with Liberty allegedly admitting the installation had been faulty, and the insured was paid by Nationwide for said damages.

Nationwide now seeks restitution for said payment, in the amount of $16,081.36, as well as a $500 deductible to the insured. The plaintiff said it tried to contact the company repeatedly and collect said amount, to no avail.
